Trump's DOJ Permanently Banned the IRS From Auditing His Family, Trusts, and Businesses

The Justice Department handed President Trump a sweeping tax shield this week, signing a settlement that permanently bars the IRS from auditing Trump, his family members, his trusts, and all of his businesses — going back years. The agreement, negotiated by Acting Attorney General Todd Blanche, was not submitted to Congress. There was no vote. It was done by signature.

The settlement resolves a Trump-initiated lawsuit over IRS scrutiny of his returns from 2015 through 2020. The terms are extraordinary: the government is "FOREVER BARRED and PRECLUDED" from examining any Trump-related tax liability. That phrase appears in the settlement document itself.

A Lawsuit That Settled on Its Own Terms

Trump sued his own government in a $10 billion lawsuit claiming IRS audits were politically motivated. Under any normal administration, the DOJ defends the IRS. Under this one, the DOJ settled on terms that benefit the plaintiff, who is also the president, who appointed the acting AG who signed the deal.

Todd Blanche was Trump's personal criminal defense attorney before becoming Acting Attorney General. He successfully argued that Trump could not be prosecuted for acts taken as president. He then signed a settlement ensuring Trump's family cannot be audited. The conflict is not incidental; it is the mechanism.

The covered entities include Trump's adult children, their spouses, associated trusts, LLCs, and all business entities connected to the Trump Organization. The IRS is permanently blocked from reopening any existing audit or initiating any new one on any of these parties for the covered tax years.

$1.8 Billion for the Fund, No Vote Required

The settlement also creates a $1.776 billion "anti-weaponization fund" inside the DOJ. The money does not require a congressional appropriation. It was quietly carved out of existing DOJ accounts. Democrats on the House Ways and Means Committee, led by Rep. Richard Neal (D-MA), have formally demanded documentation on how the fund will be governed and spent.

The fund's name frames the IRS audit program as "weaponization." The audits being settled were mandatory reviews Congress required of sitting presidents. Making taxpayers fund the settlement that terminates those reviews completes the loop: public money, spent to protect private wealth, under a legal banner that calls the oversight the crime.

Blanche Didn't Mention It Under Oath

Todd Blanche testified before the Senate Judiciary Committee in May. Senators asked direct questions about conflicts of interest at the DOJ. Blanche did not disclose the settlement or the anti-weaponization fund during his testimony. The settlement was announced publicly days later.

There is no record of Blanche recusing himself from matters involving his former client. There is no record of any ethics review of the settlement. The DOJ's Office of Professional Responsibility has not issued any public statement on the arrangement.

Governments settle tax disputes. They do not typically surrender audit authority in perpetuity for the benefit of the sitting president's entire family. That is what happened here. The DOJ gave Trump's family a permanent tax shield, and taxpayers gave them $1.8 billion to build it. The receipts exist. They just can't audit them.
